1-   Who we are?

 ArkiBee website is owned by Masa Architecture Limited (“ArkiBee”, “Masa”, “Us”, “We”, “Our”) registered in England and Wales under company number 10902468 at Unit 4, 13 Ramsgate Street, London, England, E8 2FD.

2-   Purpose of this policy

Privacy Policy (“Policy”) informs you how we collect, use and disclose your personal data, tells you about your privacy rights and lets you know how you are protected under the Data Protection Act 2018 (the “Act” for short).

By using our website and services you consent to our collection and use of your Information as described in this Policy. If we change our Policy and/or procedures, we will post those changes on our website to keep you aware of what Information we collect, how we use it and under what circumstances we may disclose it. Your continued use of the website or services after this Policy has been amended shall be deemed to be your continued acceptance of the terms and conditions of this Policy, as amended. We encourage you to bookmark this Web page and review this Policy regularly.

3-   What information do we gather?

We only collect personal information if we have your permission, or we have reasonable commercial reasons for doing this, such as collecting information to supply you with relevant services.

We may collect some of the following data such as name, birthdate, gender, job title, billing address, delivery address, business address, personal and business email addresses, telephone numbers, company that employs you or company you own, purchasing preferences and history, content you post on our websites, and content you read on our websites plus various other data you provide thru our websites. This data may be collected when you order a service or product, use our websites (or a third-party website e.g. to pay for a subscription), post content to our websites, sign up for a newsletter or subscription, on completion of a survey, questionnaire or entry to a competition, or by communication to us by email, phone and by other means.

We may also collect your business-related information that you provide us to promote your products and services by means of advertising or producing or submitting content for our websites.

When you pay us, we will record details of the financial transaction but do not directly store your debit or credit card information. Online payments are made through our websites but are processed securely by a third-party payment provider such as PayPal or Stripe.

If you use our website we may record your IP address, registration details and your browsing history such as the pages you have visited within our sites, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website.  If you sign up for a newsletter, we may track your response e.g. open a newsletter or click on a link in a newsletter or the pages you visit.

Profile data includes your username and password, purchases or orders made by you, your payments and bills, your interests, preferences, feedback and survey responses.

We do not share personal data with third parties for marketing purposes, other than with the direct consent of the individual(s) which may be withdrawn at any time.

We do not collect any private personal data about you such as your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, information about your health and genetic and biometric data, criminal convictions and offences.

This website is not intended for children and we do not knowingly collect data relating to children.

4-   How is your personal data collected?

Information you voluntarily provide to us

We collect and maintain Information that you voluntarily submit to us during your use of our website or services. For example:

  • When you register on our website or for a service, you may provide us with certain Information your identity, contact, business details and financial data
  • If you sign up to receive a newsletter or a magazine, you may provide us with contact information (e.g., email, telephone and/or or physical address)
  • You may provide us with Information in the course of email, customer support interactions, feedback and surveys.
  • You may submit a content to be published
  • You may enter a competition, promotion or survey
  • provide any personally identifiable information in the comments section to our articles.

Information we collect through your use of our Website

We use cookies to monitor web usage. Cookies are written to the hard drive of a web user; they contain no personal information about the website user and only keep a record of the sites visited and actions on the web site.  Some cookies expire after your browser is closed whilst others stay on your hard drive. They are of standard use across many websites. We use them on an aggregated information basis and to assess your areas of interest – they are used to identify the number of unique visitors to a site, to improve further web visits (store preferences, user name and your email address so you don’t need to reinput every time you visit) and to improve the user experience for you by, amongst other things, providing content based on your preferences. Information we collect and publish from open sources

We may also collect and publish your business-related data which is obtained from public records, your own personal or business website, your social media accounts or similar open sources. You may claim to control the contents of your profile pages by editing, revising, adding or subtracting the content materials or you may ask for removal of your business profile either by subscribing as a member to our website and controlling your pages or by contacting us.

Information we receive from third parties

We may also combine online and/or offline information received from third parties (including other members of our group of companies) with your Information. The third-party information is used for a variety of purposes including to verify other Information about you (e.g., verify your email or mailing address to send you requested products or services) and to enhance the content and advertising we provide to you. Our website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website

5-   How we use of your information?

We primarily collect data to provide you with services you have requested, to provide services likely to meet your needs, to improve services provided to you and to sell advertising space for third parties.

We may use some elements of the data you supply to target the messages we send you or display relevant content according to your profile.  For example, we may use some of your profile date to send you information about an event which might interest you, or we may use your company type or job title to display you a relevant news story.  We do not use this information to make automated decisions.

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you. You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing.

6-   Disclosing your information

We may disclose your personal information if required to do so by law or in good faith believing such action is necessary to comply with the law. We will not sell or otherwise share your personal information with third parties without your consent except in the following instances:

Internal Third Parties such as other companies in our corporate group who may act as joint controllers or processors and who may be based inside or outside the UK.

External Third Parties such as

  • Third party employers who you have requested we pass your details to as part of our website in order to provide potential employment opportunities.
  • Third party sponsors promoting competitions on our website which you have entered.
  • Service providers who may act as processors based inside or outside the UK and who provide IT, system administration and other services.
  • Professional advisers who may act as processors including lawyers, bankers, auditors and insurers based inside or outside the UK who provide consultancy, banking, legal, insurance and accounting services.
  • HM Revenue & Customs, regulators and other authorities who may act as processors based inside or outside the UK who require reporting of processing activities in certain circumstances.
  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
  • In the event we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Policy.

7-   Data retention        

Data is not kept any longer than is required for the purposes of the processing or to comply with the law. As we collect data for many different purposes there is not a single retention period for all data. We instead carefully assess the length of time to retain data according to the processing purpose and to comply with our legal obligations. When data is no longer required for the purposes of the processing it is securely removed from our systems.

8- Security & Confidentiality

No data transmission over the Internet can be entirely secure, and therefore we cannot guarantee the security of your personal information and/or use of the website. Any information that you send is at your own risk and may be read by others. However, once we have received your personal information, we take commercially reasonable physical, technical and administrative measures to protect personal information from theft, misuse or accidental destruction and to keep it confidential. We aim to protect personal information but cannot provide a 100% guarantee of security.  All employees and data processors (third parties who process data on our behalf) who access your data are obliged to keep the information confidential and secure and not to use it for any other purpose other than that they are contracted to carry out for us.

9-   Legal basis for processing data

  • When data is provided when purchasing a product or service under a contract with you, we process your data under contract necessity with the data being needed to fulfil the contract.
  • When you sign up for a newsletter, an event or magazine subscription we process your data under consent
  • Any additional processing i.e. sharing data with third parties, marketing to you on behalf of third parties is done through either consent or legitimate interest (you are provided with useful information by us in exchange for supplying your information (including personal data) and the relationship between us is balanced in your favour. You have the choice to opt out of processing under this basis).
  • When you pay us, or we pay you, we only keep data as long as it is necessary to comply with the law.         

10- Your legal rights

You have the right to see, erase and correct data we hold, the right to restrict the processing we do, and the right to object to it and to have your data transferred to a third party. If you wish to do any of these things or have any questions about how we use your data, or wish to make a complaint about any privacy issues, please contact us.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

11- Withdrawal of consent

When you receive marketing communications from us you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the marketing e-mail or newsletter.

When you have provided consent, if you should wish to withdraw that consent, you can let us know by emailing info@arkibee.com including the email address and brand associated with your account and we will remove your data from our systems. Requests will be dealt with and responded to within a reasonable period, and no longer than 30 days.

12- Restriction of liability

Our websites link to other websites and social media websites. We are not responsible for the privacy policies of those websites nor does it have or accept any liability for their content.

We do not control how your personal information is collected, stored or used by such third-party sites or to whom it is disclosed. You should review the privacy policies and settings on any social networking site that you subscribe to so that you understand the information they may be sharing. If you do not want your networking sites to share information about you, you must contact that site and determine whether it gives you the opportunity to opt-out of sharing such information. We are not responsible for how these third-party sites may use information collected from or about you.

This website uses Google Analytics, a web analytics service provided by Google, Inc. (‘Google’). Google Analytics uses cookies (text files placed on your computer) to help the website operators analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

Welcome to ArkiBee.com. By using this website or any of the ‘ArkiBee’ branded subsites and microsites, you are agreeing to comply with the following terms and conditions of use which, together with our Privacy Policy, govern ArkiBee’s relationship with you in relation to this website.

    11. you waive any moral rights in all material you submit under the Copyright, Designs and Patents Act 1988 (and all similar rights in other jurisdictions)
  2. You acknowledge and agree that you won’t be paid a fee for the content that you submit to us. In exchange for you providing the content, the content may be featured on our site, microsites and in our other publications or may be used, published, reproduced, displayed or otherwise exploited for any other purpose as explained in paragraph 3.1.a.
  3. You agree to immediately notify us in writing by email to info@arkibee.com by giving full details if a third party threatens to make, or makes, a claim that the content you have submitted or send us infringes its rights or makes any other claim relating to the rights granted by the licence in paragraph 3.1.a. You agree to provide us with all assistance that we may reasonably require with regards to any such claim that is made or threatened.
  4. You agree to indemnify us against all liabilities, costs, claims, damages, losses and expenses arising as a result of a breach by you of any of the warranties in paragraph 3.1 (including but not limited to any claim or action against us that the content infringes any rights of any third parties) and as a result of you not notifying us in writing in accordance with paragraph 3.5.
  5. Whilst you acknowledge that we do not necessarily pre-screen any material that you have submitted to the Site, we reserve the right to remove, at any time and without reason or prior notice or any liability to you, any material that you have submitted.
  6. Notwithstanding the generality of section 3.1 above, MASA reserves the right (but not the obligation) to monitor any communications that are made via the Site and you now consent to any such monitoring.

MASA has not reviewed these third-party websites and does not control and is not responsible for these websites or their content or availability.     3. Sharing your username and password with any other person or making it available to multiple users on a network is strictly prohibited and may cause to your user rights to be cancelled immediately and let MASA to take legal actions if required.
    4. If you become aware of any unauthorised use of your user name and password or any other breach of security, immediately notify MASA by sending an appropriately worded email to info@arkibee.com.
    5. MASA cannot and will not be liable for any losses, damages or costs arising from your failure to comply with these requirements.
  2. In addition to free content accessible only by registered users, certain parts of the site or some parts of the content may only be accessible to registered users who enrol to a paid membership plan of the site.
    1. When you register to enrol a paid membership plan on the site, you must provide your name, email address, telephone number and postal address, together with credit or debit card details and authorisation to deduct payment.
    2. By enrolling to a paid membership plan as announced and listed on the site, you are acknowledging that in addition to this Terms and Conditions agreement, you are complying with the paid membership plans’ terms and conditions as informed during your paid membership subscription process.
    3. Your credit or debit card will be debited when you click Submit Order on a paid site membership plan. You will see an online confirmation page and receive an email acknowledging that your order has been received and is being processed. A legally binding contract is formed on the date we send you a Membership Registration Confirmation via email. We will not be responsible if you do not receive the Membership Registration Confirmation because you have supplied us with an incorrect email or postal address.

  4. You are solely responsible for the accuracy and content of your User Information and you agree to keep it up to date. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password.

6-   Delivery of content

We provide access to digital content through our websites, apps, or mobile sites using the email address/es you provide at the time of registration. We will use reasonable endeavours to provide reliable access to our digital content, but we do not undertake or warrant that access will be uninterrupted. From time to time, we may temporarily suspend all or part of the digital content for emergency repair; maintenance or improvement without notice; and scheduled support and maintenance on notice to you.

  1. MASA endeavours to ensure that the Website is normally available 24 hours a day, however it shall not be liable if for any reason the Website is unavailable at any time or for any period.   1. In the event that any provision of these Terms & Conditions is held to be invalid or unenforceable, the remainder of these Terms & Conditions shall remain valid and enforceable
  2. These Terms & Conditions shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction.
